1.Purpose
- The Network exists so that vetted professionals can refer work to one another with confidence. This code protects that confidence. It binds every member, at every Network event and in every Network channel, online and in person.
2.Professional dealing
- Deal honestly. Quote what you can deliver, deliver what you quote, and communicate early when something changes.
- Honour referrals. Work passed to you through the Network is served at the standard and rates you published to the Network.
- Do not poach. Do not use the directory or a Network introduction to divert another member's existing client or engagement.
- Disclose conflicts of interest before accepting referred work, not after.
3.Respect and inclusion
- Treat every member, guest, host and venue with respect. No harassment, hate speech, discrimination or bullying, in any channel, at any time.
- Events may be photographed for Network use. Tell the host at the start of an event if you do not want to appear in photographs, and we will accommodate that.
4.Confidentiality and information
- Member contact details and rates in the directory are for referral use inside the Network. Do not export, scrape or sell them, and do not add members to marketing lists without their consent.
- What a member shares in confidence at a Network event stays in confidence.
5.Guests and representation
- Guests attend under the invitation and responsibility of the member who brings them, and this code applies to them while they attend.
- Do not represent yourself as speaking for the Network or the Company without written permission.
6.Breaches and sanctions
- Raise suspected breaches with the Company in writing. We investigate fairly, hear both sides, and decide within twenty business days.
- Sanctions scale with the breach: a written warning, suspension from events or the directory, or cancellation of membership for serious or repeated breaches. Fees are not refunded on cancellation for a serious breach, unless the law requires otherwise.
- Nothing here limits any legal right of a person affected by a member's conduct.
7.Disputes, governing law and jurisdiction
- These terms are governed by the law of the Republic of South Africa.
- The parties first attempt to resolve any dispute by good-faith negotiation between senior representatives within ten business days of written notice of the dispute.
- If negotiation fails, the parties may agree to mediation in Cape Town or by video conference before either approaches a court or, where agreed in a signed agreement, arbitration.
- The parties consent to the jurisdiction of the Magistrates' Courts with jurisdiction over our registered address, without excluding either party's right to approach the High Court of South Africa, Western Cape Division.
- Nothing in this clause prevents a consumer from using any statutory complaint or redress channel available under South African consumer protection law.
